Terms of Use

1. Scope

These terms of use apply to the MagicPoster apps for iOS and Android, the App Clip and the associated online functions. The provider is Denscha IT & E-Commerce e.K., owner Dennis Scharf, Regensburg.

By registering or continuing to use the website after a significant change, you agree to the version displayed. Until the required consent is given, an existing account can be read but not managed or changed.

2. Account and Access

You must provide correct information, protect access data and may not use third-party accounts, links or MagicPoster keys without authorization. Accounts and projects may be temporarily blocked in the event of security risks or serious violations.

If you use Sign in with Apple or Google, permanent account deletion requires you to sign in to the linked provider again. An Apple link will be revoked if necessary; The MagicPoster account will then be deleted unless there are legal retention requirements.

3. Purchases, Subscriptions and Refunds

In-app purchases are processed via Apple or Google Play, depending on the platform. The price shown in the respective store purchase dialog, the term and the store conditions apply. The respective store provides purchase receipts, billing information, subscription management and refunds; MagicPoster does not create its own end customer invoice for these in-app purchases.

MagicPoster stores verified transaction and entitlement data to server-side associate purchases to an account and the intended project, prevent reuse, and enable permissible restores across platforms. Consumption purchases will only be restored through this account association. Pending, canceled or declined purchases do not unlock any functionality.

4. Responsibility of the project owner

The project owner bears the primary contractual responsibility for setting up his friends or Photo Book or his WiFi page, for the invited guests, for his own content and for the ongoing moderation of the contributions published via his project.

He must distribute access and links appropriately, check reported or obviously illegal content promptly and use available deletion and blocking functions. This assignment of responsibility does not transfer all of MagicPoster's legal obligations to the project owner.

5. Responsibilities of Contributors and Rights

Each guest remains responsible for their own upload, its legality and all necessary copyright, personal and consent rights. You may only upload content that you are permitted to use and view to the intended people.

You keep your rights. You grant MagicPoster the technically necessary, non-exclusive rights to store, process, secure, moderate and display the post for the selected function to authorized persons.

6. Prohibited content and protection of minors

In particular, sexual or exploitative content involving minors, pornographic content, glorification of violence, threats, harassment, hatred, fraud, spam, illegal content, violations of copyright or personal rights and the publication of third-party personal data without authorization are prohibited.

Content by or about children must be age-appropriate. Adults must be authorized to upload and have the necessary consents. Suspicious or illegal content can be removed, secured and reported to the relevant authorities.

7. Reporting, Moderation and Blocking

Guest posts in Friend Books and Photo Books can be reported with a reason and an optional description. The project owner can check contributions, reject reports, delete contributions and block contributors to this book, provided a reliable contributor ID is available.

MagicPoster does not generally pre-screen content, adopt it as its own, or use a general automatic content filter. Technical file, MIME, size, malware and security checks remain possible.

MagicPoster retains the legally required inspection, information, security, deletion and blocking rights and may intervene in the event of legal violations, dangers or misuse. Tips about WiFi owner content can be reported to hello@getmagicposter.com.

8. Availability and Changes

We strive to ensure safe and stable operations. Maintenance, technical disruptions, changes from Apple or other platforms as well as necessary security measures may temporarily limit functions. Mandatory legal claims remain unaffected.

9. Termination and Deletion

You can delete your account and content using the provided functions. Subscriptions already taken out with Apple or Google Play must also be canceled in the subscription management of the respective store. Legally required purchase, security, misuse or proof data can be stored blocked for the prescribed period.

10. Data Protection

Information about account details, media, contributor IDs, reports, moderation histories, Apple and Google Play transactions, provider registration, token revocation and service providers used can be found in the app data protection and the general Privacy Policy.

Please send questions, technical problems, complaints and tips about illegal content to hello@getmagicposter.com. If possible, include the MagicPoster key, the affected project and the post. We process reports in accordance with the applicable legal requirements.
